2. Acceptance
By using the Site, contracting our services or providing us with any data, you fully accept these Terms and Conditions and our Privacy Policy. If you don't agree with any point, don't use the Site nor contract the services.
3. What Pasivoo does and DOES NOT do
Pasivoo is a service that:
- Provides you with an automated strategy that operates inside your own personal account at the broker VT Markets, regulated by ASIC (Australian Securities and Investments Commission).
- Guides you through the initial setup (tutorials) and offers support.
- DOES NOT manage, custody or access your money. Your capital always lives in your personal account at the broker.
- IS NOT a registered financial advisor and does not provide personalised advice.
- DOES NOT guarantee returns, profits or preservation of capital.
4. Investment risk
You acknowledge and accept that the decision to invest and the amount to invest is solely your decision, under your own responsibility.
5. Requirements to contract
- Be of legal age (18 or older).
- Have legal capacity to contract.
- Accept VT Markets's terms and open an account with them using our link.
- Have a recommended minimum capital of 2000€ (or USD equivalent).
6. Fee model
Pasivoo charges exclusively 30% on the net profits YOU generate through the strategy, calculated at the close of each monthly period.
- If you don't generate profits in a period, we charge nothing.
- No monthly fees, paid courses, subscriptions or up-front charges.
- We only charge commission on new profits once your account exceeds its historic high (high-water mark concept).
- Invoices are issued by EXOLUTIONS CONSULTING LLC and reflect applicable taxes per jurisdiction.
7. User responsibilities
As a user you commit to:
- Provide truthful data and keep it up to date.
- Not use the service for illicit, fraudulent or unlawful purposes (including anti-money-laundering compliance).
- Securely safeguard your credentials for the broker account and our platform. Don't share them with third parties.
- Understand that the strategy operates in your account and under your control: you activate, pause or cancel whenever you want.
8. Suspension and termination
- You can pause the strategy from your broker panel at any time, with no penalty.
- You can withdraw your capital (partial or full) directly from your broker account.
- You can request termination of the service and deletion of your data by writing to info@pasivoo.com, without prejudice to legal data retention obligations.
9. Intellectual property
All Site contents (text, graphics, logos, code, video) are property of EXOLUTIONS CONSULTING LLC or their respective owners and are protected by applicable law. Reproduction, distribution or commercial use without prior written authorisation is prohibited.
10. Limitation of liability
To the fullest extent permitted by law, EXOLUTIONS CONSULTING LLC will not be liable for:
- Financial losses arising from trading in financial markets.
- Decisions you make based on information shown on the Site.
- Broker interruptions, technical issues outside our systems, force majeure or fortuitous events.
11. Changes
We may update these Terms to adapt to regulatory, technical or service changes. Changes take effect upon publication on the Site. We'll notify you by email of material changes.
12. Applicable law and jurisdiction
These Terms are governed by the applicable law of Wyoming, United States. For users resident in the European Union, mandatory consumer and user protection rules of their country of residence are respected. Any dispute will be submitted to the competent courts, without prejudice to the right to out-of-court dispute resolution.
